Terms of service

DRAFT. This is a plain-English draft, written before launch. It has not been reviewed by a lawyer, it is not final, and nothing here is binding until we publish a final version and you accept it. We will tell you before it changes.
What we promise you, what we ask of you, and what happens to your data if you leave. Written to be read.
1. What this covers
These terms are the agreement between you (the salon or barbershop that signs up) and Fairbooked ("we"). They cover the booking, calendar, client, reminder, payment and reporting tools we provide, and this website.
Where we say "your clients" we mean the people who book with you. Where we say "your data" we mean the client list, appointments, notes, services, staff details and payment records that you and your clients put into the product.
2. What you pay
- A flat subscription of CA$49 a month for the whole shop, for any number of team members. Founding salons pay CA$29 a month (see section 3).
- No free trial. Billing starts when you go live, and you have a 30-day money-back from that date (see "Money-back" below).
- 0% commission on any booking, including a client's first booking. We never bill you based on where a booking came from.
- Card payments: connect your own Stripe account in two minutes for deposits, no-show protection and tap-to-pay checkout, or keep your current card machine and record payments in Fairbooked. Stripe bills and pays you directly; we never touch your money and take nothing from your card payments. See section 6 and our pricing page.
- Card reader optional for deposits and no-show fees. For in-person tap checkout, Stripe readers from about CA$79 (Bluetooth) or CA$419 (countertop, S700).
- Reminders and confirmations by email and SMS are included, with no per-message fee.
- Sales tax is added where the law requires it.
The subscription is never charged per person. Taxes, including HST, are added on top of the subscription where the law requires it.
Money-back. If you are not happy, ask within 30 days of the day you go live and we will refund the subscription you paid for that period. Card fees and optional hardware, such as a Stripe card reader, are charged by Stripe or your card machine provider and are not covered by our refund. 3. The price lock (subscription only)
Founding salons. The first 50 salons that go live with us pay CA$29 a month for the subscription, locked for 24 months from the day they go live, as long as they remain our customers without a break. We will not raise that price during the lock, and this promise is part of the agreement, not a marketing line. After the lock the subscription moves to our list price, currently CA$49 a month, and we will give at least 12 months' written notice before it does.
The lock covers our subscription only. It does not cover card rates. Stripe, or your card machine provider, sets its own rates and may change them under its own terms.
Everyone else. We will give at least 12 months' written notice before we change our subscription price for any customer, and a change never applies to a period you have already paid for.
If we ever cannot honour this, you may leave at once and export all your data, and we will not charge you to do either.
4. Your data belongs to you
Your data, and in particular your client list, is yours. We hold it and process it to run the product for you. We do not sell it, we do not use it to market to your clients, and we do not claim any right to it beyond running the service and meeting our legal duties.
You are responsible for having the right to store your clients' details and to send them messages, including their consent where the law asks for it.

5. Leaving, and the 90-day export
- You can cancel at any time, inside the app, with no notice period and no fee.
- You can export your clients, appointments, services, staff and payments as a ZIP of CSV files whenever you like, for free, before and after you cancel.
- After you cancel, your data stays available to export for 90 days. After that we delete it, except records we are required by law to keep, such as payment records.
- Saved card details cannot be exported from any payment system. If you move away, your clients will need to add their cards again.
If we ever decide to close the service, we will give you at least 90 days' notice and a full export.
6. Card payments
If you connect Stripe, you hold your own Stripe account under Stripe's terms (Stripe Connect Standard). Stripe bills you its card rates and pays you directly; we never touch your money, and we earn nothing on card payments. You may instead keep your own card machine and record payments in Fairbooked.
Stripe, or your card machine provider, may review or delay payouts for any merchant under its own risk rules, and we do not control that. If it happens to you, we will help you sort it out, and we will tell you what we know as soon as we know it.
7. Reliability
We publish the state of the service on the status page and post problems there in plain words. If our service is down for an hour or more during your opening hours, we credit your account for each hour. How the credit is worked out will be set before these terms are final.
We cannot promise the service will never have a fault. We do promise to tell you when it does, and to keep your data safe and exportable while we fix it.
8. What we ask of you
- Give us accurate details, and keep your sign-in secure.
- Use the product lawfully, including your duties under privacy and anti-spam law when you message clients.
- Do not try to break, overload or reverse-engineer the service.
9. Limits on our liability
We work hard to get things right, but the service is provided as it is. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability to you is limited to the fees you paid us in the 12 months before the problem. Nothing in these terms limits liability that the law does not allow us to limit.
10. Changes to these terms
Changes to our subscription price follow section 3. For any other change, we will email you at least 30 days before it takes effect. If you do not agree with a change, you can leave and export your data first.
11. Governing law and contact
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. This choice is a placeholder until a lawyer confirms it.
